1. I understand and acknowledge that participation in this activity involves inherent risks, including but not limited to physical injury, illness (such as motion sickness) or personal property damage.

2. I voluntarily assume all risks associated with my participation and hereby release SeaEscape Charters, LLC, its officers, employees, agents, and representatives from any and all liability for any injury, loss, or damage sustained by me during or as a result of my participation.

3. I agree to abide by all rules, regulations, and instructions provided by SeaEscape Charters, LLC and its representatives during the course of the private charter.

4. I understand that this waiver is a legally binding agreement and will be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

5. I certify that I am physically fit and capable of participating in this activity.

6. I agree that this waiver shall be governed by and construed in accordance with the laws of Rhode Island, and any dispute arising out of or in connection with this waiver shall be subject to the exclusive jurisdiction of the courts of Rhode Island.
